Luxembourg committed to establishing a level playing field with regard to transparency on tax rulings; provides Commission with requested information

At today’s European Council meeting, Prime Minister Xavier Bettel has announced that, in the light of the Commission’s decision to review the practices of all Member States with regard to tax rulings, and in view of the upcoming European directive on the mandatory automatic exchange of information on tax rulings, Luxembourg has decided to provide the Commission with the list of the tax rulings issued by the Luxembourg tax administration, as well as with the list of the beneficiaries of the IP box regime, as previously requested.

This decision also implies that Luxembourg will withdraw its relating legal actions for annulment of the Commission’s injunction decisions, currently pending before the European Courts.

Xavier Bettel comments: “The vast majority of EU Member States issue tax rulings. Luxembourg is strongly in favour of the creation of a level playing field with regard to international taxation and tax rulings. The Commission’s decision to review the tax practices of all Member States, as well as the upcoming European directive introducing a mandatory automatic exchange of information on tax rulings, are important steps in that direction. Luxembourg’s decision to provide the Commission with the list of the tax rulings issued by the Luxembourg tax administration, as well as with the list of the beneficiaries of the IP box regime, is a clear illustration of Luxembourg’s commitment to finding common solutions on a European level. “
